So, I'm watching the Cubs v Pirates 1991

I learned that Ryne Sandberg and Larry Bowa were traded to the Cubs for Ivan Dejesus.

I really miss Harry Carey even though its been 12 years or so. The uniforms were better then, the oversized jerseys and yoga pants they wear now are ridiculous. Maybe they need that to cover up the roid use? BTW if you don't thing they are using HGH these days, you are blind, stupid, or both. Don't be that guy.

Barry Bonds is laughably smaller in 1991. Frankly it looks like some of the players had started to bulk up especially the foreign players.

Andre Dawson and Ryno were still thin though. Its a day game and there are 7 people watching at 3 rivers. BTW the hawk hit 2 grand slams in the series. Cubs lost both games. This was his 13 or 14th season.

Wash Rinse Repeat - Heritage Style

Catchy title eh?

I was going to write a review of 2010 Topps Heritage Baseball, but everyone has already done that, so instead I will leave you with last years posts. I got a ton of hate mail over them, but they still apply. I'll leave you with this, you can tell Heritage is a big ol crap on the front lawn price wise because 2009 Heritage High number is $45 a box, but the regular is as high as $90 and there isn't much of a difference.

Over at ballcard mania, sorry no link I'm on my iPhone, there is a discussion that there are 7 super sp's. A few have been identified such as thom glavine, stupid, hanley ramirez in a bosox hat, Smoltz in a bosox-braves thing and 3 or so others. There is another one that is alledgedly unidentified.

The kick in the ass is that these are 1. Intentional 2. "errors" 3. So damn rare.

I get that these are an homage to the original set but why do it. These are the most gimmicky of all. The 07 jeter card was stupid but at least you could pull it with ease. The "errors" that were made look terrible. How did Topps decide to do a "thom" card? Third, the cards are way too short printed. I don't mind if there are 1 or 2 different cards but at least make them all one per case. Rare enough to chase common enough to pull.

I have the same problem with the Allen & Ginter case break. The Kos-fu is one per case and may have been inserted late. The nno minis and such just frustrate people. I didn't get even 1.

I think that Topps may have another trick up it's sleeve with the super sp's. One may be blaster or retail only; or certain case dates have different sp's. You might find the last one isn't found until later shipments. I get that the cases are "sold out". But that doesn't mean they are shipped at the same time. Maybe one is going to be found in the "high number" series.

Here is a suggestion to Topps. Cut the current player relics and autos and only include autos of the old guys. That should cut costs and you can then cut the price and thus sell more. I don't care about another brian mccan single color jersey.

First, really? You're banging on me because I made a comment about not knowing who Fausto fucking Carmona is? Really? Let's take a look at his stats. The man is 28-25 with a 4.19 ERA. Lest we not forget last year's 8-7 5.44 ERA performance. That might be enough to get you into a Donruss Banner Season insert set, but he is still a shit pitcher on a mediocre team. Sorry, I didn't know about a crap pitcher. Actually I had heard of the guy, regardless, if that's the auto I am going to pull, no thanks. The card was also considered a 'big hit"

Second, The set takes you back to your childhood when packs of cards were less than $1? Yeah jerkwad, these cards are $3 a pack. Plus, you have 75, yeah, 75 Sp's to try and get. The breaks on these boxes have been horrific. Troll around the Forums and you will see a Brooks Robinson "seat" card, 4 chromes and a vg+ buy back. That is considered a pretty good box. Really? How many boxes is it going to take you to complete a set? The only thing Heritage takes, is the money from your bank account and puts it into Topps bank account ya big ass. By the way, for the cost of less than 4 boxes, you can have a set with SP's. So keep dropping $75 a box on these and good luck building that set. At least masterpieces only has 30 sp's and they can be had for 1/2 a box of Heritage.

I just don't "get it". These run $80 a box, the relics are horrible. Don't get me wrong, I would love to pull red ink autos of Fausto Carmona whoever the hell he is.

Really? $80 a box for bland ass relics, autos of people I have never heard of, buy back cards that are vg+ or Ex. Gee thanks Topps. Of course the people on this thread think its the best steamy pile ever. At least the chromes are nice.

There just aren't any rookies to drive this product because of the way the prospect sets are done now. Baseball is by far my favorite sport, but I hope the BB card market absolutely collapses so it gets a fresh start.

Masterpieces Group Case Break

I have gotten lots of emails from interested parties, but its time to get down to bidness.

So who is in?

Well, are you? There are only 4 spots not including me.
Cost is $80 a person. To give you an idea, shipping is $11 to get the cards to you and paypal fees are $2-3. So for the cost of a couple boxes you get 4 boxes worth of autos, jerseys, black framed, YSL, and red frame.

Rules:
you would get all of the basecards and shortprints, Yankees Stadium Legacy Cards (these sell shockingly well), black framed and red framed except for any that I might need for my set, which is few. You would get all of the jerseys and all of the black framed autos. You would also get any printing plates.

I would keep all of the numbered parallels, the YSL jersey card (if there was one), and any jersey/auto, patch, or patch/auto.

This offer is available to as many people that would be interested. At first blush it may seem odd, but I don't have any interest in the jersey cards and the autos I have most of them.

Giving Donruss/Panini a fair shake

I haven't done so in 2009/10. I was kind of hard on 2008 Donruss products for the poor condition of the cards out of the pack, terrible hits i.e. rookie free agent autos, and sticker autos. In fact, I haven't bought a Panini product since they took over.

Frankly Upper Deck Mops the floor with Panini in my opinion but I think its time I give them a second chance.

So what product should I open, limited, threads, the premium basketball?

An attorney at Quinn Emanuel emailed me and let me know the reason for all of the hits I received from their various offices. He also told me that he did not bill for that time as he was not on the case.

He, in very eloquent and formal writing, let me know that he has a google setting that informs him of articles that feature Quinn Emanuel and it had little to nothing to do with the article itself.

I am mailing out the Sp Authentic cards today. I still need an address for Peterson. The canadia people, your cards will go out sometime this week. I have to go to the Post Office when they are open and that will be tomorrow or Wednesday.

It's the Base cards Marty, I have to talk to you about the Base cards.

Base cards are the enemy of the group break host. Sorting packing and shipping them is quite a chore. The more you have, the more time it takes. Don't get me wrong, I'm not complaining.

One of the breaks I have open is UD Ultimate Football. I have had a few requests to either convert it to SP Authentic or open up a new 2008 SP Authentic group break. I might do so but the ultimate is much easier for me to do given the number of base cards involved with each. Plus I think Ultimate is a better product but I do see the appeal of Sp Authentic and why people think its better. The SP authentic rookie patches are much more popular than Ultimate, and the patches are better. I like Ultimate because of fewer base cards and, in my opinion the checklist is better

I might be more interested in doing an SP authentic group break if everyone was ok with receiving a team set, all the hits, and all the SP's. I would donate any extra base cards like Gellman does with the ones that people don't want. Thoughts?

Its really not that good

My little scratches and blather about the UD lawsuit is getting way too much attention. Upper Deck has hit the article 15 times and Quinn Emanuel (UD's lawyers) have done it 12. It surprises me as the article was a stream of consciousness post with bad spelling and grammar. The least either could do is offer me a job or pay me for it if they think its worth reading that many times.

As I said before Quinn Emanuel knows their stuff, actually they are a top 5 firm if I remember correctly. UD is paying through the nose but is getting their money's worth. Hopefully UD isn't getting billed for QE to read my post, but I would say they most likely are.

The Upper Deck Lawsuit for Dummies (including myself)

Gellman at SCU has been posting about the lawsuit and today stated that he might have been an alarmist about the whole thing. UD sure is pushing the envelope here and Gellman is right, they may be in some deep crapola.

Here is the injunction brief by Upper Deck.

I'm going to try and make this as simple as I can. I'm not a copyright lawyer but some general concepts apply. Basically, any logos in the pictures of the cards are incidental to the product.

Accounts of the game:

You know that language at the end of or during the game that goes : "Any rebroadcast, retransmission, or account of this game, without the express written consent of MLB" Yeah. well Major League Baseball is full of shit on that one. Rebroadcast yes, Retransmission yes, accounts of the game? An emphatic NO!

It's called news people. Newspapers, news broadcasts can certainly talk about what happened in the game. I don't know why MLB even puts that in there. Some dumbass lawyer that thought it sounded good probably. So accounts of the game are fair game unless you appropriate someone else's account as your own then you have a problem.

What about the statistics?
The quick answer is no. Statistics are facts and are thus not copyrightable (subject to copyright) if that is even a word.

So far we have a card with statistics on it.

What about the players names and using them to make cash?

Upper Decks got that covered Y'all! Some smart lawyer figured out that MLBPA was the key. The player through MLBPA is allowing their likeness to be used. UD might still be ok without the MLBPA, but their fight is much easier with the rights they secured.

So now we have a card with stats, accounts of a game and the player's picture.

What about players in their uniforms with logos showing? Now we are to the meat of the issue. This is the only real issue in the case as all of the other bases are covered.

To simplify this I am going to call this the Newspaper defense. Assuming UD secured the rights to the photograph, there is no difference in what UD is doing to what a newspaper does. UD is "reporting" what the player's statistics were for the past year and the previous years. Just like a newspaper, UD is selling their reporting for money. Sometimes they include autographs and pieces of jerseys and such on their "reports". There are no logos on the cards other than what are contained in the photos and their use in the photos is incidental.

UD could probably use the names of the teams on their cards as well. It is a fact that Manny Ramirez plays for the Los Angeles Dodgers. There is no logo being used to show that the cards are endorsed by MLB.

That's the next issue is dilution of the copyright, etc. Dilution means to basically reproduce the copyright, trademark so it becomes worthless to the holder. Producing hats with the logo on it would be taking dollars away from MLB who owns that logo. What is the distinction you ask? UD isn't reproducing the logos that are on the uniforms as the centerpiece of the card like they are on a jersey or hat that one would reproduce to sell just like a newspaper that runs a photo of Jeter from the World Series. They aren't selling the logo, just the news that goes along with it. For examples of what MLB has done on this front see here note the main concern was with audio and such, also see here note this is all a discussion about how the pictures can be used on the internet and other things and not in newspapers.

The result of the links is that MLB is on shaky ground and realizes that they can only enforce certain limitations through contract and not copyright law. That's my point, there is no copyright violation here because of the way UD went about this. They are no different than a newspaper to a degree and if MLB thinks they can keep newspapers from posting things on the internet, they are dead ass wrong. Bloggers just haven't had the money to fight Selig and his money grubbing cronies.

Plus UD has tried to make sure their is no confusion and that's why blog articles were used. Everyone at this point, or at least anyone that has half a brain and pays attention, knows taht UD lost thier license and have plastered it on their packaging, thus there is no confusion or at least there shouldn't be.

The above is surely not a legal treatise but hopefully it gives you an idea as to what arguments can be made. With the backlash that has come to the RIAA over copyright infringement and being as heavy handed about enforcement as they are I would suspect there are many judges that wouldn't think twice about dismissing the suit. And, DMCA RIAA is much clearer than in this situation.

Upper Deck and the SP Authentic Football

SP Authentic Football, in its current form, may be one of the best products ever. But before I break the awaiting boxes of joy, provided they arrive today, I have a thought or two on how it could be improved.

First, the boxes are just a tad too expensive. Not on a content basis per se. 3 hard signed cards per box is nice, but how many of those are throw away scrubs. Quite a few from what I opened of 2008. I opened damn near a case. Personally I only care about the RAP's and the jersey autos. The plain autos are a tough pill to swallow and usually have no value. I would rather UD stick with 1 jersey/patch/auto and an additional patch card or auto for a total of 2 hits. They could then drop the price $10 or so. I would imagine that the third hit does cost around $10-$20 to produce. I would rather be able to snag an RPA at a $75 price point than $100.

Second, these should come in 6 box cases. Nothing worse than opening box after box without a case hit, especially at this price point. Think Master Case of 12 boxes and two inner cases.

The corners look to be sharp and the pack did look unmolested but why do all the cards I see pulled from vintage packs seem to be so off center? The answer is simple. When people look at the packs they can see the cards. There is no way the off center cards are worth more than the sealed pack so no one opens them. Then someone comes along and doesn't know any better and opens the pack.

I was impressed with Olberman's knowledge and it was clear that he wasn't faking his descriptions. He is a true collector with a lot of money and is good for the hobby.

Cost is $80 a person. To give you an idea, shipping is $11 to get the cards to you and paypal fees are $2-3. So for the cost of a couple boxes you get 4 boxes worth of autos, jerseys, black framed, YSL, and red frame.

Rules:
you would get all of the basecards and shortprints, Yankees Stadium Legacy Cards (these sell shockingly well), black framed and red framed except for any that I might need for my set, which is few. You would get all of the jerseys and all of the black framed autos. You would also get any printing plates.

I would keep all of the numbered parallels, the YSL jersey card (if there was one), and any jersey/auto, patch, or patch/auto.

This offer is available to as many people that would be interested. At first blush it may seem odd, but I don't have any interest in the jersey cards and the autos I have most of them.

Don't get me wrong, I think TS is completely out of touch with today's cards, however sometimes you have to give credit where credit it due. TS posted about Keith Olberman opening a pack of 67 Topps on the air. Personally I think its cool. Others commented that he and his cards should be incinerated, insert political BS and junk here. We all have those friends that are either so ignorant that they know nothing about politics, and all they do spew rhetoric all day long. This applies to both sides.

Second baseball group break

As you can imagine, I have received a lot of emails about the second break. The reason why I canceled it is that the second break is less stable than the first break, in that participants come and go. I have no idea how full the thing is going to be until just a few days before I ship things.

Second, too many participants. If each person would commit to at least two teams whether it be the same team in both breaks or more than one team in a single break I could do it.

Some of you do have multiple teams and I have tried to lessen the cost for you. The higher end breaks with less cards are easier and thats why I have mixed it up this month with ultimat, exquisite and base topps.

Also, I am going to do a finest case again this year and it is going to be a slot break. Much like last year with a couple of changes. Each person is going to get an auto or a redemption or more than one and the refractors are going to be given out in slots too. Some of you got raked over the coals last year and I don't want that to happen again.

Are fake inscriptions next

A few days back I was thumbing though my sports collectors monthly reading articles, looking at what has come out, etc when I noticed the back page full of autograph guests. There were prices for flats, balls, jerseys, bats. Some of theless greedy guys just do a one size fits all price. I think it's great that these guys are doing this, they have a lot of fans and some of them probably need the money. Sad but true. The only autograph ball I have is a Pete Rose. The Ball is special to me for reasons other than it was signed by Rose. I don't care if he is an auto whore, a man has to make money.

One of the prices I was suprised to see was an additional fee for "inscriptions". Art Shell is free for an inscription whereas Warren Moon is $25 and Jerry Rice is $79. Then I saw this auction where the number is counted as an "inscription". Oooohhh, not so sure about that pal. That begged the question, are scammers going to use cards with legitimate autos and add fake inscriptions?

Inscriptions are all the rage these days. 57 points, 18 rebounds. 2.44 GPA. You know...things like that. What keeps Burgeylicious from doing something like that?

One note on the Pete Rose auto whore. Trust me, Jordan, LeBron, those guys aren't any better. They do the same thing, its just not at a table in Vegas, or was it?

A Shockey Development

See what I did there? Anyway, while not as impressive as Matt's completion of the 77 Topps Football Mexican set, I can tell you that I am looking forward to completing the 2008 masterpieces football patch set. I was down to 3, Shockey, Ocho Cinco and Bush. I have seen 1 Bush and 1 shockey and not a single Ocho.

When you are on a Mission from the card gods sometimes you have to venture into West Quahog and do some things you are not proud of. Mine was venturing over to the Beckett Marketplace and purchase a Jeremy Shockey Patch Card for my set. Set building mania knows no loyalty however, thus, I did it. I admit it, forgive me for my sins.

Meanwhile, there is another patch set collector out there. He is paying ridiculous prices for common patches and at last count is yet to be half way there.

What a horrible fake

of my boy Kurt. Looking at his huge Warner collection he has up right now, he was probably just a rube that happened to buy it.

Tough Pulls: 1993 Topps Black Gold

Topps had jumped into inserts in 1992 and was increasing their numbers by 1993. In 1992 Topps issued the gold versions of each basecard. Each card had the name and team stamped in gold. Pretty interesting cards at the time. Foil stamping was slowly becoming the standard.

In 1993 Topps issued "Black Gold" inserts along with the regular gold which were 1 per pack, 2-3 per cello and rack pack. Black Golds were inserted at 1 per box or less. There were 44 cards total, 11 in each series of A, B, C, and D and if I recall correctly they were inserted at different rates based upon the series. These were issued in Baseball, Football, Hockey and Basketball.



As you can see, there was a funky diamond cut foil board type stuff to use. There is no indication of damaged cards and as far as I know the only issue was centering. Why do these qualify as tough pulls? Simple, building a set of these took case after case after case just to amass the 44 cards.

Topps threw a curveball as well. As in 1992 Topps Gold, Topps issued "Winner" cards that were good for all 11 cards of a particular series. In 1992 the gold cards were stamped with an extra "winner" insignia to differentiate the winners from the much tougher pack pulls.

I don't know the insertion rates of the winners and it was not apparent that the cards had been marked as such. If someone could confirm this for me that would be great. I couldn't imagine trying to build a set of these back in the day, the regular gold cards were tougher because of sheer number of them. Regardless the winner cards killed the value pretty quickly on these. These are nice looking cards and can be picked up cheaply for sure.

Most of the time we just take everyone's word for it that the jersey is the jersey, the patch is the patch and the auto is the auto. With jerseys and patches we can't disprove anything so we are stuck with what we have. Also, think about how hard it is with fake patches? Unless its a jersey that was never worn, we have no evidence. Blowout does have its share of idiot posters, but these guys seem to have a clue about what is going on.

I was thinking, I said to my Joe collectoring self, I says "Joe, what about doing a group break of say 82 topps?" Then I says to myself, I says "Joe, what about doing a team based group break of say 77 topps?"

1 box maybe 2 maybe 3, random teams or first come first serve teams and the teams would be ranked. For example, if we did 82 topps the Orioles would pay more than say the Tigers.

Thoughts? I could change the monthly box breaks to add a vintage box to the mix. COuld you imaging 2 boxes ultimate, 2 boxes 2010 Topps and 1 box 83 topps? Then we wouldn't rank the teams other than what we do already and any teams not represented in the vintage break would get discounts, ie marlins, rockies.

Ok, here's the deal. Alex (the american one, not the aussie) sent me an email asking about a discount on having multiple teams or being involved in multiple breaks. Ask and ye shall receive.

From March Forward, for each team or break you are involved in after the first, you get a progressive discount. ONLY IF YOU PAY AT THE SAME TIME FOR ALL OF THE BREAKS.

Second team or break discount: 1.00
Third team or break: 1.50
Fourth Break and thereafter discount 2.00

If you end up paying at different times I pay the paypal fees on each payment. I can always return your multiple payments so you can pay at the same time

Vintage Unopened Wax

Well at least it is unopened since it was resealed.

You never know when you will run across a vintage wax box for cheap. Some old timer digs out a box of 60's Topps and has no idea what its worth or some pipe dream like that, but its not a game that I would get into. Its funny, all those hits that companies make now do cost some cash to produce, thus boxes must be like lottery tickets to a degree. Back in the day, a Mantle cost the same to make as a Ron Swaboda, thus it made no difference to Topps how many they made of each.

As a collector we understand that what is in our box will most likely not fall for another couple of cases unless it is a Early Doucett framed parallel. That's my point, a box of 74 topps can only be so damn good. Same with those $1000 rack packs. THose things have got to be a huge let down once you have plunked down the cash.

2009 Ultimate Group Break is Filled and an announcement

The group break was filled this morning.
